Description
Whether a broker is the procuring cause of a sale must be factually determined on a case-by-case basis. Many factors can impact a determination of procuring cause, events such as the first property showing, writing a successful offer, or an existing agency relationship with the buyer are not, in and of themselves, exclusive determiners of procuring cause/entitlement.

This session will review the arbitration process, the definition of procuring cause and its applicability to a hearing panel in determining who is “entitled” to the commission. We will examine several case studies to help guide us in better understanding “procuring cause”.
